Welcome to PeckCheck. These Terms of Service (“Terms”) govern your access to and use of the PeckCheck website, reports, tools, content, and services (collectively, the “Service”).

By accessing or using PeckCheck, creating an account, submitting parcel information, purchasing a report, or otherwise using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

1. What PeckCheck Does

PeckCheck provides informational land and parcel analysis reports. Our reports may include checks related to parcel boundaries, zoning, flood risk, wetlands, slope, access, utilities, septic/sewer indicators, public records, listing information, and other land-related factors.

PeckCheck is designed to help users identify potential red flags and areas that may require further investigation before buying, developing, financing, improving, or using land.

PeckCheck is a screening and research tool only. It is not a final authority on whether land can be purchased, developed, built on, financed, insured, accessed, subdivided, permitted, or used for any specific purpose.

2. Informational Use Only

PeckCheck reports are for informational and educational purposes only.

PeckCheck does not provide legal, engineering, surveying, architectural, environmental, financial, tax, insurance, title, appraisal, permitting, septic, construction, or real estate advice.

A PeckCheck report is not a substitute for:

3. No Professional Advice

PeckCheck does not act as your attorney, engineer, surveyor, architect, real estate broker, appraiser, title professional, insurance advisor, environmental consultant, septic designer, contractor, lender, or permitting consultant.

No information provided through the Service should be interpreted as professional advice, a professional opinion, a permit approval, a legal conclusion, a zoning determination, a survey, a title review, an appraisal, an environmental determination, or an engineering analysis.

You are solely responsible for obtaining professional advice and official confirmations before relying on any information related to a parcel or property.

4. No Guarantee of Buildability

PeckCheck does not guarantee that a property is buildable, usable, accessible, financeable, insurable, eligible for permits, eligible for septic approval, legally compliant, or suitable for any specific purpose.

Even if a report identifies a property as having lower friction or fewer visible issues, there may be hidden restrictions, legal problems, title issues, easements, soil limitations, utility limitations, HOA/CC&R restrictions, deed restrictions, permitting issues, environmental issues, road access issues, or local rules that PeckCheck does not detect.

A final buildability, permitting, access, septic, utility, zoning, or land-use decision can only come from the appropriate government authorities, utility providers, licensed professionals, and other qualified parties.

5. No Government Affiliation

PeckCheck is not a government agency and is not affiliated with any county, city, state, federal agency, assessor, recorder, planning department, zoning office, environmental agency, health department, utility provider, or permitting authority.

PeckCheck reports are not official government determinations, approvals, permits, certificates, inspections, surveys, title reviews, zoning letters, septic approvals, environmental determinations, or legal records.

You should contact the relevant government offices, agencies, utility providers, and licensed professionals directly to confirm all important information.

6. Friction Ratings and Verdicts

PeckCheck may provide scores, statuses, friction ratings, risk levels, buildability indications, summaries, recommendations, or verdicts, including labels such as “Low Friction,” “Medium Friction,” “High Friction,” “Unknown,” “Low Risk,” “Medium Risk,” “High Risk,” or similar terms.

Any PeckCheck score, status, friction rating, risk level, buildability indication, summary, recommendation, or verdict is an estimate based on available data and automated analysis. These ratings are not official determinations and do not guarantee that a parcel is buildable, usable, accessible, insurable, financeable, eligible for permits, eligible for septic approval, legally compliant, or suitable for any specific use.

A “Low Friction” result means PeckCheck did not identify certain obvious issues in the available data reviewed. It does not mean the property is safe to buy, legally buildable, approved for construction, free from hidden restrictions, free from title issues, free from access problems, free from site conditions, free from utility limitations, free from zoning restrictions, free from septic limitations, free from environmental constraints, or free from permitting problems.

A “Medium Friction” result means PeckCheck identified some uncertainty, limitations, or possible issues that may require additional investigation. It does not mean the property can or cannot be used or built on.

A “High Friction” result means PeckCheck identified possible red flags, missing information, or conditions requiring further investigation. It does not mean the property is impossible to use or build on.

An “Unknown” result means PeckCheck did not have enough available data to assess that item, and it should be confirmed directly with the relevant source.

You should not rely on PeckCheck ratings as the sole basis for buying, selling, financing, developing, improving, or using land.

7. Data Sources and Limitations

PeckCheck uses public records, government datasets, third-party data providers, listing pages, maps, parcel data, geospatial data, AI-assisted interpretation, and user-submitted information.

These sources may be incomplete, outdated, inaccurate, unavailable, mislabeled, approximate, or inconsistent across counties and jurisdictions.

PeckCheck does not control the accuracy, availability, update frequency, or completeness of third-party or government data sources.

You understand and agree that:

8. AI and Automated Analysis

PeckCheck may use automated tools, algorithms, AI models, geospatial analysis, rule-based systems, and other automated methods to generate reports.

Automated analysis may make mistakes, miss issues, misunderstand documents, misread data, interpret information incorrectly, or produce conclusions that appear confident but are wrong.

AI systems may generate incorrect statements, omit relevant information, misunderstand documents, misread data, or produce incorrect conclusions.

You should treat PeckCheck as a screening and research tool, not as a final authority.

You are responsible for independently verifying all report findings before relying on them.

9. Zoning, Septic, Flood, Wetlands, Access, and Utility Limitations

Zoning information may be incomplete, outdated, or subject to overlays, special districts, conditional-use rules, minimum lot sizes, setbacks, road frontage requirements, subdivision rules, deed restrictions, HOA/CC&R restrictions, and local interpretation. Confirm zoning and allowed uses directly with the local planning or zoning department.

Septic feasibility cannot be determined by PeckCheck. Soil ratings, slope, lot size, water features, setbacks, prior permits, and public records may suggest risk, but only the appropriate health department, environmental agency, licensed septic professional, or required site testing can determine septic approval.

Flood, wetland, stream, protected land, and environmental layers are informational only and may be incomplete or approximate. Regulatory determinations may require agency review, field delineation, permits, elevation certificates, engineering review, or other professional analysis.

PeckCheck may identify possible road frontage or access indicators, but it cannot confirm legal access, easements, title defects, private road rights, recorded restrictions, or landlocked status. Confirm access through title review, recorded documents, surveys, and local authorities.

Utility proximity or map visibility does not guarantee service availability, connection approval, capacity, cost, easement rights, or installation feasibility. Confirm water, sewer, electric, gas, internet, and road access directly with providers and local agencies.

Allowed uses such as manufactured homes, modular homes, RV living, camping, livestock, poultry, accessory structures, short-term rentals, home businesses, or other uses may depend on zoning, overlays, deed restrictions, HOA/CC&Rs, health rules, nuisance rules, minimum acreage, permits, and local enforcement. Confirm directly with the county and other applicable authorities.

10. User-Submitted Information

You may submit property addresses, listing URLs, APNs, parcel IDs, coordinates, documents, descriptions, or other information to PeckCheck.

You are responsible for making sure that any information you submit is accurate and that you have the right to submit it.

By submitting information to PeckCheck, you give us permission to use it to operate the Service, generate reports, improve data quality, provide support, prevent abuse, and improve PeckCheck.

You agree not to submit unlawful, misleading, harmful, infringing, private, confidential, or unauthorized information.

11. Accounts

Some features may require an account. If you create an account, you are responsible for keeping your login information secure and for all activity under your account.

You agree to provide accurate information and to update it when necessary.

We may suspend or terminate accounts that violate these Terms, abuse the Service, attempt to bypass payment, scrape data, attack the website, misuse reports, or create risk for PeckCheck or others.

12. Payments

PeckCheck may offer paid reports, subscriptions, credits, packs, or other paid features.

Prices, features, and availability may change at any time.

Payments are processed by third-party payment providers. PeckCheck does not store full credit card numbers.

By purchasing a paid report, credit, pack, subscription, or feature, you authorize the applicable charge and agree to any pricing, billing, and payment terms shown at checkout.

After you purchase a parcel check, PeckCheck may begin retrieving data, running automated analysis, using AI systems, performing geospatial analysis, and generating the report immediately. You understand that computing, AI, data retrieval, geospatial analysis, and report-generation costs may be incurred as soon as the check begins.

If PeckCheck offers subscriptions or automatically renewing plans in the future, the applicable renewal terms, billing frequency, cancellation process, and renewal price will be disclosed at checkout.

13. Checkout Acknowledgment

Before purchasing a paid report, credit, or parcel check, you may be required to acknowledge important limitations of the Service, including that PeckCheck is informational only, does not provide professional advice, does not guarantee buildability, usability, access, financing, insurance, septic approval, permit eligibility, or legal compliance, may rely on incomplete or inaccurate data, and is generally non-refundable once processing begins.

By checking an acknowledgment box, clicking a purchase button, or completing a payment, you agree to the limitations, disclaimers, refund terms, and payment terms shown at checkout.

14. Refunds

Unless otherwise stated at checkout, paid parcel checks are generally non-refundable once the parcel check begins, because PeckCheck may immediately incur computing, AI, data retrieval, geospatial analysis, and report-generation costs.

We may consider refunds in our discretion if:

We do not guarantee refunds because public data is unavailable, limited, incomplete, outdated, inconsistent, or because a report identifies risk, uncertainty, or a result the user did not expect.

15. Free Checks, Credits, and Paid Packs

PeckCheck may offer free checks, promotional checks, paid credits, paid packs, or usage limits.

Free checks and promotional credits may be subject to expiration, availability, account limits, daily limits, abuse-prevention rules, and other restrictions shown in the Service.

Paid credits and paid packs do not expire. Credits you have already purchased remain available for use in your account, subject to availability, account limits, abuse-prevention rules, and the other terms shown in the Service.

PeckCheck may change, pause, limit, or discontinue free checks, promotional credits, or the availability of paid packs at any time; credits you have already purchased will remain usable.

Users may not create multiple accounts, use fake information, or attempt to bypass usage limits, payment requirements, or abuse-prevention systems.

PeckCheck, including the website, reports, design, text, graphics, logos, software, analysis structure, and report format, is owned by PeckCheck or its licensors and is protected by intellectual property laws.

You may use PeckCheck reports for your own personal property research or internal business evaluation.

You may not copy, reproduce, modify, sell, publish, distribute, or create competing products from PeckCheck content without our written permission.

18. Third-Party Services and Links

PeckCheck may include links to third-party websites, maps, government portals, listing sites, data providers, payment processors, or other services.

We do not control and are not responsible for third-party websites, services, data, policies, or content.

Your use of third-party services is governed by their own terms and policies.

19. No Time-Sensitive Reliance

PeckCheck should not be used as the sole source of information for time-sensitive real estate, financing, permitting, construction, investment, or land-use decisions.

You are responsible for obtaining official confirmations and professional advice before deadlines, offers, purchases, closings, financing decisions, permit applications, construction activity, or other time-sensitive actions.

20. Changes to Reports and Data

Reports may reflect the data available at the time they are generated. Data sources, maps, public records, zoning rules, environmental layers, listings, and other information may change after a report is created.

PeckCheck is not obligated to update previously generated reports unless we specifically offer that feature.

A report generated at one time may not reflect later changes in law, records, maps, ownership, zoning, environmental conditions, utility availability, agency interpretation, or site conditions.

21. Disclaimers

The Service is provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, PeckCheck disclaims all warranties, express or implied, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, non-infringement, availability, and error-free operation.

We do not warrant that:

To the fullest extent permitted by law, PeckCheck and its owners, employees, contractors, partners, service providers, and affiliates will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages.

We may also update, change, or remove features, data sources, report formats, pricing, free checks, paid packs, availability, or functionality.

We may update these Terms from time to time. If we make material changes, we will update the effective date above and may provide additional notice.

Your continued use of the Service after changes become effective means you accept the updated Terms.

26. Termination

We may suspend or terminate your access to PeckCheck if you violate these Terms, misuse the Service, create risk for PeckCheck or others, or if we discontinue the Service.

You may stop using the Service at any time.

27. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes will be handled in the state or federal courts located in California, unless otherwise required by law.
